FruitTree Marketing LLC provides enterprise endpoint protection, ransomware defence, email security, cloud management and related cybersecurity solutions for business customers under the FruitTree Endpoint brand. Specific features, service levels and licensing terms may be defined in a separate order form, subscription agreement or statement of work.

2. Eligibility and Accounts

Our services are intended for business and organisational use. You must provide accurate registration information and maintain the confidentiality of account credentials. You are responsible for all activity that occurs under your account.

3. Acceptable Use

You agree not to misuse our services. Prohibited activities include, without limitation:

• Attempting to gain unauthorised access to our systems or other users' data.
• Interfering with or disrupting the integrity or performance of our services.
• Using our services in violation of applicable law or third-party rights.
• Reverse engineering, copying or reselling our services except as expressly permitted.

4. Subscriptions and Payment

Fees, billing cycles and payment terms are set out in your applicable agreement. Unless otherwise stated, subscriptions renew automatically. Failure to pay may result in suspension or termination of services.

5. Intellectual Property

All software, documentation, branding, website content and related materials remain the property of FruitTree Marketing LLC or its licensors. We grant you a limited, non-exclusive, non-transferable licence to use our services in accordance with your agreement.

6. Customer Data

You retain ownership of data you submit to our services. You grant us the rights necessary to host, process and secure such data to provide and improve our services, subject to our Privacy Policy.

7. Confidentiality

Each party agrees to protect the other's confidential information using reasonable care and to use it only for purposes related to the services.

8. Disclaimers

Our services are provided on an "as is" and "as available" basis to the fullest extent permitted by law. While we strive to deliver reliable cybersecurity protection, we do not warrant that our services will detect every threat or prevent all security incidents.

9. Limitation of Liability

To the maximum extent permitted by law, FruitTree Marketing LLC shall not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or business opportunities. Our total liability arising from these Terms or the services shall not exceed the fees paid by you for the services giving rise to the claim during the twelve months preceding the event.

10. Termination

We may suspend or terminate access to our services if you breach these Terms or fail to pay applicable fees. Upon termination, your right to use the services ceases, though provisions that by their nature should survive will remain in effect.

11. Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law principles. Disputes shall be resolved in the courts located in Sheridan County, Wyoming, unless otherwise agreed in writing.

12. Changes

We may modify these Terms from time to time. Continued use of our website or services after changes become effective constitutes acceptance of the revised Terms.
